We reserve the absolute right to suspend or terminate your account at our sole discretion, at any time, for any reason, without notice or liability. You are strictly responsible for safeguarding your account credentials and for any activity that occurs under your account.
GenesiAI retains all rights, title, and interest in and to the Clara platform, including all underlying technology, algorithms, and designs. While you retain ownership of the input data you provide, you grant GenesiAI a worldwide, perpetual, royalty-free license to use, reproduce, and process such inputs. Furthermore, due to the nature of machine learning, AI outputs may not be highly unique across different users. We disclaim any liability regarding the copyrightability or trademarkability of any AI-generated content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GENESIAI, ITS AFFILIATES, DIRECTORS, SHAREHOLDERS, OR EMPLOYEES BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL THEORY WITH RESPECT TO THE SERVICE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING LOSS OF PROFITS OR DATA). OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION SHALL BE STRICTLY ZERO DOLLARS ($0.00). IF YOU ARE DISSATISFIED WITH THE PLATFORM, ANY GENERATED CONTENT, OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO IMMEDIATELY DISCONTINUE YOUR USE OF THE SITE.
You agree to defend, indemnify, and hold harmless GenesiAI and its affiliates from any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which GenesiAI is registered, without regard to its conflict of law provisions.
